Welcome to Sellizo. The terms “we”, “us” and “our” refer to Sellizo and ChaCha MiD Limited (“Company”), a company legally registered at 2719 Russell Dr, New Kensington, PA 15068. We operate this website and store, including all related information, content, features, tools, products and services (collectively, the “Services”). Sellizo is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing products, you may be asked to provide certain information (such as your email address, billing, payment, and shipping information). You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

You are responsible for providing accurate shipping and contact information. We are not responsible for delivery issues caused by incorrect or incomplete address details provided at checkout.

Some products sold by Sellizo may be new, open-box, shelf-pull, overstock, or customer-return items, as described on the product page. Packaging may show signs of handling or storage. Unless explicitly stated otherwise, these conditions do not necessarily impact the product’s intended functionality.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services. However, colors or product appearance may differ from how they appear on your screen due to the device you use and your device settings.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be exactly as depicted.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase products from Sellizo. We reserve the right to accept, decline, limit, or cancel any order at our sole discretion, including (without limitation) in cases of suspected fraud, unauthorized or illegal transactions, pricing or inventory errors, delivery restrictions, or if we are unable to fulfill the order.

Your order is not accepted until we send an order confirmation (or shipping confirmation) to the email address provided at checkout and your payment has been authorized and processed. Please review your order carefully before submitting it.

If we decline, modify, or cancel an order after you have submitted it, we will attempt to notify you using the email, billing address, and/or phone number provided at checkout. If your payment has already been processed for a canceled order, we will issue a refund to your original payment method.

Returns and exchanges are handled only in accordance with our Return & Refund Policy.

You represent that your purchases are not intended for unlawful resale or export.

Order Cancellations

If you need to cancel an order, contact us as soon as possible. Once an order has entered processing, fulfillment, or shipment preparation, it cannot be canceled. Requests to cancel after this stage may be refused, and the order will need to be handled as a return in accordance with our Return & Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices posted in our online store may differ from prices offered by third parties. We may offer promotions from time to time that may affect pricing and that are governed by separate terms and conditions. If there is a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our store. You agree to promptly update your account and other information so that we can complete your transactions and contact you as needed.

You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use it for the purchase; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay charges incurred at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

Shipping and delivery times shown at checkout or on the website are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, natural disasters, labor disruptions, customs inspections, or other events beyond our control.

To the extent permitted by law, responsibility for delivery transfers to the carrier once the package is handed over for shipment. If your package is lost or damaged in transit, please contact us and we will assist you in working with the carrier and determining the best resolution.

SECTION 5A - RETURNS CONDITION

Returned items must be received in the same condition as delivered. Items returned used, installed, incomplete, or missing original packaging or accessories may be declined or may be eligible only for a partial refund, as permitted under our Return & Refund Policy.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Sellizo, its affiliates or licensors and are protected by U.S. and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants you a license or other rights under any patent, trademark, copyright, or other intellectual property of Sellizo, Shopify, or any third party. All rights not expressly granted are reserved.

Sellizo’s names, logos, and slogans are trademarks of Sellizo or its affiliates or licensors. Shopify’s name and logo are trademarks of Shopify. All other names, logos, and marks are the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without any endorsement.

Any use by you of optional tools is entirely at your own risk and discretion. We may also offer new features or tools in the future, which shall be deemed part of the Services and subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links to websites provided or operated by third parties. We are not responsible for examining or evaluating their content or accuracy. If you leave the Services to access third-party websites, you do so at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Sellizo is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Sellizo. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sellizo.

Because our Services are hosted by Shopify, Shopify may also collect and process information about your access to and use of the Services to provide and improve its platform. Shopify’s privacy practices are described in Shopify’s privacy policy.

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

Some jurisdictions limit or do not allow the disclaimer of implied warranties, so the above disclaimer may not apply to you.

To the fullest extent provided by law, in no case shall Sellizo or its affiliates, partners, directors, officers, employees, agents, contractors, service providers, licensors, or those of Shopify and its affiliates be liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Services or products purchased through the Services.

You agree to indemnify, defend and hold harmless Sellizo, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, claims, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or rights of a third party, or your access to and use of the Services.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
